Terms of Service
1. The service
Is This Rental Real? offers human-reviewed, informational rental-risk research. Based on the information you provide and information reasonably available at the time, we may identify inconsistencies, warning signs, unanswered questions, and practical steps you can take before sending money.
The current advertised price is $19 for one Rental Risk Review. There is no subscription or recurring charge. Unless we state otherwise, most reports are delivered by email within 24 hours after we receive the information needed to begin. Delivery times are estimates, not guarantees.
2. Important limitations
A Rental Risk Review is a limited snapshot. It cannot prove that a property, landlord, advertiser, company, listing, lease, payment request, or transaction is legitimate, fraudulent, safe, or unsafe. Information can be incomplete, inaccurate, outdated, copied, impersonated, or changed after a review.
We do not provide legal or financial advice, title searches, inspections, appraisals, background checks, tenant screening, identity verification, law-enforcement investigations, escrow services, insurance, or guarantees against loss. The service is not a consumer report and must not be used to make decisions about another person’s eligibility for housing, credit, employment, insurance, or another legally regulated purpose.
You remain responsible for your decisions. Independently verify the property, the person’s authority to offer it, lease terms, and payment instructions before acting. If you suspect fraud or have already sent money, contact your financial institution and appropriate authorities promptly.
3. Eligibility and customer responsibilities
You must be at least 18 years old and able to enter into a contract. You agree to provide information you reasonably believe is accurate and to use the service only for lawful, personal purposes.
You may submit only content you have the right to share. Do not submit Social Security numbers, bank information, full card numbers, passwords, driver’s licenses, passports, medical records, or other highly sensitive information. Remove unrelated personal information from screenshots and documents when practical.
4. Acceptable use
You may not use the website or reports to:
- Harass, threaten, stalk, dox, defame, discriminate against, or harm another person.
- Conduct tenant screening, a background check, or another regulated eligibility decision.
- Submit unlawful, deceptive, infringing, malicious, or unauthorized content.
- Attempt to gain unauthorized access, interfere with the service, evade security controls, scrape the site, or resell reports.
- Misrepresent a report as a guarantee, official investigation, legal conclusion, or finding of fraud.
5. Payment, cancellation, and refunds
Payment is processed by Stripe. You authorize the one-time charge shown at checkout. Taxes, if required, may be added or handled as described at checkout.
If you made a duplicate purchase, were charged incorrectly, or believe we did not provide the purchased service, contact support@isthisrentalreal.com. Refund requests are reviewed based on the circumstances and applicable law. Nothing in these Terms limits any non-waivable consumer rights.
6. Reports and communications
You authorize us to contact you at the email address you provide about your order, request additional information, and deliver your report. You are responsible for providing a working email address and checking filtered or spam folders.
Reports are prepared for the purchasing customer and the specific rental information submitted. You may use your report for your own personal decision-making, but you may not sell it, alter it to misrepresent our findings, or present it as an official certification or guarantee.
7. Your content and our materials
You retain ownership of content you submit. You give us a limited permission to host, copy, review, analyze, and otherwise use that content only as reasonably necessary to provide, secure, document, and support the service and comply with law.
The website, report format, branding, text, graphics, and other materials we provide are owned by us or our licensors and are protected by applicable intellectual-property laws. We give you a limited, personal, non-transferable right to use the service and your report in accordance with these Terms.
8. Third-party services
The service uses or links to third-party providers, including Stripe for payment and Jotform for intake and contact forms. Those providers may apply their own terms and privacy policies. We are not responsible for third-party websites, services, availability, or content.
9. Disclaimers
To the fullest extent permitted by law, the website and service are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that a report will identify every risk, inconsistency, or instance of fraud.
10. Limitation of liability
To the fullest extent permitted by law, Is This Rental Real? and those working on its behalf will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost money, opportunities, data, or profits arising from the service or a rental transaction. Our total liability arising from a particular paid review will not exceed the amount you paid for that review.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. These Terms do not exclude liability that cannot legally be excluded.
11. Refusal or termination of service
We may refuse or stop service when information is insufficient, a request is unlawful or unsafe, these Terms are violated, or providing the service would create unreasonable risk. If we decline a paid review before providing substantive work, we will address the payment as required by applicable law.
12. Governing law and disputes
These Terms are governed by the laws applicable where Is This Rental Real? operates, without regard to conflict-of-law rules, except where the law in your place of residence requires otherwise. Before filing a claim, you agree to contact us and allow a reasonable opportunity to resolve the concern informally. Nothing in this section prevents either party from using a court or process that cannot lawfully be waived.
13. Changes to these Terms
We may update these Terms as the service changes. The revised version will be posted here with a new effective date. Changes apply prospectively unless the law permits otherwise. Your continued use after an update means you accept the revised Terms.
